Form 1 in South Australia: A Guide for Adelaide Home Sellers

  • A Form 1 is a mandatory legal disclosure statement that South Australian sellers must give buyers before a sale proceeds.
  • It must cover council details, zoning, money owed on the property, and any restrictions on the land.
  • An inaccurate or late Form 1 can allow a buyer to withdraw from the sale, even after signing the contract.
  • Conveyancers typically prepare and serve the Form 1, reducing the risk of errors or missed deadlines.
  • The Form 1 must be served before the buyer’s cooling-off period begins.

If you are preparing to sell your home in Adelaide, you will quickly come across the term Form 1. Most sellers find it a little overwhelming at first, and that is understandable. It is dense with legal language and detail that is not always straightforward. Even so, it is a required part of South Australia’s selling process, and getting it right helps you avoid stress, delays, and potential legal complications later.

This guide explains what a Form 1 actually is, why it matters, and how a conveyancer can help you manage it correctly.

What Is the Form 1?

A Form 1 is an official disclosure statement that South Australian home sellers are legally required to give buyers. It contains important information about the property before the buyer commits to the purchase.

A Form 1 typically includes council details, zoning rules, money owed on the property, and any restrictions on what the buyer can do with the land. It is not optional. It must be given to the buyer by law, and it must be served correctly and on time.

Why the Form 1 Is So Important

The Form 1 protects both seller and buyer. For buyers, it supports an informed decision. For sellers, it helps prevent future disputes over undisclosed property details.

If information that should have been included is missing, the buyer may be entitled to withdraw from the sale, even after signing the contract, and in some cases pursue legal action. Accuracy in a Form 1 is not a formality. It is a legal requirement with real consequences if it is incomplete or incorrect.

Think of it as similar to an ingredients list on food packaging. A buyer would not knowingly purchase something that conflicts with their needs, and they certainly should not commit a large sum of money to a property without knowing its condition and any limits on what they are allowed to change.

Who Prepares the Form 1?

Usually, a conveyancer prepares and serves the Form 1 on the seller’s behalf. They know how to gather the correct documents from the council, the Lands Titles Office, and other government bodies, and they check for errors or missing details so the form cannot be challenged later.

Sellers can attempt to prepare a Form 1 themselves, but for most people, it is safer and far less stressful to leave it to an experienced Adelaide conveyancer.

Timing Matters: Serving the Form 1

The Form 1 needs to be given to the buyer before the cooling-off period begins. If it is served late or incorrectly, the buyer’s cooling-off period may be extended, or the sale itself could be put at risk. According to the South Australian Law Handbook, where a contract has already been signed, the Form 1 must generally be provided to the purchaser at least 10 clear days before the settlement date.

Your conveyancer tracks all of this on your behalf and ensures the form is delivered correctly and on time.

What Happens After the Buyer Gets the Form 1?

Once the buyer receives the Form 1, their cooling-off period begins. This is a short window in which they can change their mind without incurring major penalties. Once that period ends, the contract becomes considerably more secure for the seller.

If the buyer has questions about anything in the form, your conveyancer will help address them.

Why Sellers Shouldn’t Rush the Form 1

Some sellers want to rush through the paperwork to sell faster, but hurrying can backfire. A missing detail or an outdated search result can give the buyer grounds to walk away later. Taking the time to get the Form 1 right is always preferable to dealing with delays or a lost sale further down the track.
